1. Foreign Trade Statistics Regulations; Reporting the Value of Foreign Military Sales Shipments (63 FR 41186 on August 3, 1998)

Commentary: The Bureau of Census has amended the Foreign Trade Statistics Regulations (FTSR) by adding a section requiring exporters or their designated agents to include a foreign military sales indicator code on the Shipper’s Export Declaration (SED) Form, Automated Export System (AES) Record Layout, and Automated Export Reporting Program (AERP) Record Layout.

 

2. Proposed Amendment to Foreign Trade Statistics Regulations To Clarify Exporters’ and Forwarding Agents’ Responsibilities and To Clarify Provisions for Executing a Power of Attorney (63 FR 41979 on August 6, 1998)

Commentary: The Bureau of Census has issued a proposed rule to clarify exporters’ and forwarding agents’ responsibilities for providing the reporting information on the Shipper’s Export Declaration (SED), and to clarify the provisions for executing a power of attorney when exporters authorize forwarded agents to perform services regarding the export of merchandise out of the United States. This proposed rule would make the U.S. manufacturer, seller or order party the Exporter of Record in cases where the forwarder has served in this capacity on behalf of a foreign principal. This proposed rule also will further clarify the provisions for executing a power of attorney when the principal party is transmitting SED information electronically. The Census Bureau also proposed requiring that the SED be prepared in English. Written comments regarding this proposed rule must be submitted on or before October 5, 1998.

 

3. Bureau of Census; Automated Export System (AES) Program Status (63 FR 54438 on October 9, 1998)

Commentary: On June 19, 1995, the Treasury Department’s Custom Service announced the implementation of the Automated Export System (AES), a reporting system jointly developed by the Bureau of Census (Census Bureau) and the Customs Service (Customs) allowing for the electronic transmission of shipper’s export information, in the Federal Register (60 FR 32040). The notice informs the public of the current status of the AES program and enhancements that will be made to the AES as a result of Interest Based Negotiations (IBN) between Customs, the Census Bureau, and representatives of the trade community to create a more viable export reporting program. The Census Bureau and Customs are developing regulations to implement provisions and requirements for filing export information electronically using the AES.
