1. Office of Defense Trade Controls: Notifications to the Congress of Proposed Export License (63 FR 4519 on January 29, 1998)

Commentary: The Department of State has published a Notification of a Proposed Export License to Congress that exceeds the $50,000,000 Congressional Notification threshold. The License is for export to the Kingdom of Saudi Arabia.

 

2. Office of Defense Trade Controls: Notifications to the Congress of Proposed Export Licenses, Correction to Public Notice No. 2652 (63 FR 5987 on February 5, 1998)

Commentary: The Department of State has published a Notification of Proposed Export Licenses to Congress that exceeds the $14,000,000 and 50,000,000 Congressional Notification threshold. The licenses are for exports to Japan, Singapore, and the United Kingdom. Also, a notification of a Technical Assistance Agreement with Germany and Sweden was sent to Congress.

 

3. Bureau of Political-Military Affairs; Office of Nuclear Energy Affairs; Interagency Procedures for Implementation of the U.S. IAEA Safeguards Agreement (63 FR 7041 on February 11, 1998)

Commentary: The Bureau of Political-Military Affairs is issuing a notice setting forth U.S. agency procedures for implementation of the Agreement Between the United States of America and the International Atomic Energy Agency for the Application of Safeguards in the United States, with Protocol (IAEA INFCIRC/288).

 

4. Bureau of Political-Military Affairs, Determination Under the Arms Export Control Act (63 FR 9039 on February 23, 1998)

Commentary: Pursuant to Section 654(c) of the Foreign Assistance Act of 1961, as amended, notice is hereby given that the Acting Under Secretary of State for Arms Control and International Security Affairs and Director of the Arms Control and Disarmament Agency have made a determination pursuant to Section 81 of the Arms Export Control Act and have concluded that publication of the determination would be harmful to the national security of the United States.

 

5. Bureau of Political-Military Affairs: Imposition of Chemical and Biological Weapons Proliferation Sanctions on a Foreign Person (63 FR 9039 on February 23, 1998)

Commentary: Berge Aris Balanian (fugitive from justice previously residing in Germany, and last known to be in Lebanon.)

 

6. Office of Defense Trade Controls: Reinstatement of Eligibility to Apply for Export/Retransfer Authorizations Pursuant to Section 38(g)(4) of the Arms Export Control Act (63 FR 10672 on March 4, 1998)

Commentary: The Department of State has suspended its statutory debarment against Fuchs Electronics (Pty) Ltd. (Fuchs), the Fuchs Electronics Division of Reunert Limited, and, any divisions, subsidiaries, associated companies, affiliated persons, and successor entities pursuant to Section 38(g)(4) of the Arms Export control Act (AECA)(22 U.S.C. 2778) and §127.11(b) of the International Traffic in Arms Regulations (ITAR)(22 CFR Parts 120-130) effective February 27, 1998.

 

7. Office of Defense Trade Controls: Notifications to the Congress of Proposed Export Licenses (63 FR 13441 on March 19, 1998)

Commentary: The Department of State has published a Notification of Proposed Export Licenses to Congress that exceeds the $14,000,000 and 50,000,000 Congressional Notification threshold. The licenses are for exports to Korea, Germany, United Kingdom, Philippines, Taiwan, Sweden, Denmark, Norway and Greece.

 

8. Renewal of Defense Trade Advisory Group Charter and Notice of Meeting(63 FR 15254 on March 30, 1998)

Commentary: The updated Charter of the Defense Trade Advisory Group has been renewed for a two-year period. The Charter was revised for clarification. The Defense Trade Advisory Group will meet beginning at 9 a.m. on Friday, April 17, 1998. The membership consists of private sector defense trade specialists appointed by the Assistant Secretary of State for Political-Military Affairs who advise the Department on policies, regulations, and technical issues affecting defense trade.

 

9. Amendments to the International Traffic in Arms Regulations (63 FR 17329 on April 9, 1998)

Commentary: The International Traffic in Arms Regulations (ITAR) has been amended by removing from the U.S. Munitions List (USML), for transfer to the Department of Commerce’s Commerce Control List (CCL), certain items when they are included in a commercial communication satellite license by the Department of Commerce. In all other cases, these items will continue to be controlled on the USML, subject to State Department licensing.

 

10.. Office of Defense Trade Controls: Notifications to the Congress of Proposed Export Licenses (63 FR 18953 on April 16, 1998)

Commentary: The Department of State has published a Notification of Proposed Export Licenses to Congress that exceeds the $14,000,000 and 50,000,000 Congressional Notification threshold. The licenses are for exports to Australia, Canada, France, Japan, The Netherlands, Norway and South Korea.

 

11.Office of Defense Trade Controls: Notifications to the Congress of Proposed Export Licenses (63 FR 20437 on April 24, 1998)

Commentary: The Department of State has published a Notification of Proposed Export Licenses to Congress that exceeds the $50,000,000 Congressional Notification threshold. The licenses are for exports to Israel and The Netherlands.

 

12. Bureau of Political-Military Affairs: Imposition of Missile Proliferation Sanctions Against Entities in North Korea and Pakistan (63 FR 24585 on May 4, 1998)

Commentary: The United States Government has determined that entities in North Korea and Pakistan have engaged in missile technology proliferation activities that require imposition of sanctions pursuant to the Arms Export Control Act, as amended, and the Export Administration Act of 1979, as amended (as carried out under Executive Order 12424 of August 19, 1994). The entities are:

  1. Changgwang Sinyong Corporation (a.k.a. North Korea Mining Development Trading Corporation) (North Korea) and its sub-units, successors, and affiliated companies; and
  2. Khan Research Laboratories (Pakistan) and its sub-units and successors.

 

13. Determination and Certification Under Section 40A of the Arms Export Control Act (63 FR 26838 on May 14, 1998)

Commentary: Pursuant to Section 40A of the Arms Export Control Act, the Department of State has determined and certified to Congress that the following countries are not cooperating fully with United States antiterrorism efforts: Afghanistan, Cuba, Iran, Iraq, Libya, North Korea, Sudan and Syria.

 

14. Bureau of Political-Military Affairs; Revocation of Munitions Exports License and Other Approvals for India (63 FR 27781 on May 20, 1998)

Commentary: The Department of State is giving notices that all licenses and other approvals to export or otherwise transfer defense articles and defense services from the United States to India, or to transfer U.S. origin defense articles and defense services from a foreign destination to India, or to temporarily import defense articles from India pursuant to Section 38 of the Arms Export Control Act, are revoked effective May 13, 1998.

 

15. Bureau of Political-Military Affairs, Determination Under the Arms Export Control Act (63 FR 28436 on May 22, 1998)

Commentary: Pursuant to Section 654(c) of the Foreign Assistance Act of 1961, as amended, notice is hereby given that the Acting Under Secretary of State for Arms Control and International Security Affairs and the Director, U.S. Arms Control and Disarmament Agency have made a determination pursuant to Section 81 of the Arms Export Control Act and have concluded that publication of the determination would be harmful to the national security of the United States.

 

16. Statutory Debarment Under the International Traffic in Arms Regulations (63 FR 29773 on June 1, 1998)

Commentary: The Department of State has imposed statutory debarment pursuant to Section 127.7(c) of the International Traffic in Arms Regulations on nine persons convicted of violating or conspiring to violate Section 38 of the Arms Export Control Act. These persons are prohibited from participating directly or indirectly in any brokering activities and in any export from or temporary import into the United States of defense articles, related technical data, or defense services in all situations covered by the ITAR.

 

17. Office of Defense Trade Controls: Notifications to the Congress of Proposed Export Licenses (63 FR 30795 on June 5, 1998, 1998)

Commentary: The Department of State has published a Notification of Proposed Export Licenses to Congress that exceeds the 50,000,000 Congressional Notification threshold. The licenses are for exports to Turkey, Korea, Finland, United Kingdom, Switzerland and Sweden.

 

18. Bureau of Political-Military Affairs: Revocation of Munitions Exports License and Other Approvals for Pakistan (63 FR 33122 on June 17, 1998)

Commentary: The United States Government has given notice that all license and other approvals to export or otherwise transfer defense articles and defense services from the United States to Pakistan, or transfer U.S. origin defense articles and defense services from a foreign destination to Pakistan, or temporarily import defense articles from Pakistan pursuant to Section 38 of the Arms Export Control Act are revoked effective May 30, 1998.

 

19. Bureau of Political-Military Affairs; Suspension of Munitions Export Licenses and Other Approvals Destined for Russian Companies and Related Matters (63 FR 41614 on August 4, 1998)

Commentary: The Department of State has suspended all licenses and other approvals for defense articles and defense services involving seven Russian entities: Baltic State Technical University, Europalace 2000, Glavkosmos, Grafit (aka State Scientific Research Institute of Graphite or NIIGRAFIT), INOR Scientific Center, MOSO Company, and Polyus Scientific Production Association.

 

20. Bureau of Political-Military Affairs; Imposition of Nonproliferation Measures Against Entities in Russia (63 FR 42089 on August 6, 1998)

Commentary: The Acting Secretary of State has determined that seven entities in Russia have engaged in missile technology proliferation activities that require imposition of measures pursuant to Executive Order No. 12938 of November 14, 1994, as amended by Executive Order No. 13094 of July 28, 1998.

 

21. Office of Defense Trade Controls: Notifications to the Congress of Proposed Export Licenses (63 FR 44484 on August 19, 1998)

Commentary: The Department of State has published a Notification of Proposed Export Licenses to Congress that exceeds the 14,000,000 and 50,000,000 Congressional Notification thresholds. The licenses are for exports to Saudi Arabia, Japan, Kuwait, Turkey, United Kingdom, Israel, and Germany.

 

22. Office of Defense Trade Controls: Notifications to the Congress of Proposed Export Licenses (63 FR 53111 on October 2, 1998)

Commentary: The Department of State has published a Notification of Proposed Export Licenses to Congress that exceeds the 50,000,000 Congressional Notification threshold. The licenses are for exports to Bosnia and Herzegovina, Israel, Germany. The Department of State also published a Notification of a proposed Manufacturing License Agreement with Taiwan; a proposed Technical Assistance Agreement with Japan; and a proposed Manufacturing License Agreement with Canada.

 

23. Office of Defense Trade Controls: Notifications to the Congress of Proposed Export Licenses (63 FR 65837 on November 30, 1998)

Commentary: The Department of State has published a Notification of Proposed Export Licenses to Congress that exceeds the 14,000,000 and 50,000,000 Congressional Notification thresholds. The licenses are for exports to Greece, Turkey, Thailand, Canada, Japan, Australia, Algeria, Israel, Italy, Singapore, Norway, Mexico, and South Korea. The Department of State also published a Notification of a proposed Manufacturing License Agreement with Japan and a proposed Manufacturing License Agreement with Canada.
